Quick answer

What is apartment association registration in Tamil Nadu?

Apartment association registration in Tamil Nadu is the statutory registration of an Association of Apartment Owners under the Tamil Nadu Apartment Ownership Act, 2022 and the Tamil Nadu Apartment Ownership Rules, 2024. It is compulsory for every building with four or more apartments, in every district of the State. The process is the same everywhere: a Form A declaration, bye-laws based on the Model Bye-laws, and a Board of Managers, all filed online with the District Registrar of the Registration Department who has jurisdiction over the building. Each project can have only one association.

FAQ

Apartment association registration questions answered

What is apartment association registration in Tamil Nadu?

Apartment association registration in Tamil Nadu is the statutory registration of an Association of Apartment Owners under the Tamil Nadu Apartment Ownership Act, 2022 and Rules, 2024. The same three-stage online process applies in every district: a Form A declaration, registration of bye-laws based on the Model Bye-laws, and constitution of the Board of Managers with the jurisdictional District Registrar.

Is apartment association registration compulsory in Tamil Nadu?

Yes. Every building in Tamil Nadu with four or more apartments must file a declaration and form an association under the 2022 Act. A contravention of the Act, Rules or bye-laws can attract a fine of up to ₹1,00,000 on conviction and up to ₹500 for each day it continues.

What is the government fee for apartment association registration in Tamil Nadu?

The Form A declaration fee is the same across Tamil Nadu: ₹5,000 for 4 to 49 apartments, ₹7,500 for 50 to 99 apartments and ₹10,000 for 100 or more apartments. Bye-law scrutiny has a separate fee. Regalwhiz shares its fixed professional fee on WhatsApp after a quick review of your building.

Can we register our apartment association online from outside Chennai?

Yes. The Registration Department runs the process online, so committees in Coimbatore, Madurai, Trichy, Salem, Hosur or any other district can register without visiting Chennai. Regalwhiz handles the filing remotely and runs owner meetings on video call.

Where do we file the apartment association application in Tamil Nadu?

The application goes to the District Registrar of the Registration Department who has jurisdiction over the area where the building is located. Appeals lie to the Deputy Inspector General of Registration of that zone. Jurisdiction follows the building, not the owners.

How long does apartment association registration take in Tamil Nadu?

Most associations complete the process in about three to four months. There is no fixed statutory timeline, and the biggest factor is how quickly the committee collects majority owner consent and builder documents.

Who can apply for apartment association registration in Tamil Nadu?

The promoter, a majority of the apartment owners, or an ad hoc committee representing the owners can file the Form A declaration. More than 50 percent of the owners must support it, and an owner of several flats counts as one owner.

Which documents are needed to register an apartment association in Tamil Nadu?

You need the approved plan and planning permission from CMDA, DTCP or the local body, the building permit, completion certificate where applicable, apartment and undivided share details, common area and limited common area schedules, the owner list, majority consent and draft bye-laws.

Can an apartment association still be registered as a society in Tamil Nadu?

Apartment owners associations are now to be registered and governed under the Tamil Nadu Apartment Ownership Act, 2022, not as a new society under the Societies Registration Act. Associations formed earlier should align their bye-laws and governance with the 2022 Act.

What is the size of the Board of Managers under the Tamil Nadu Act?

The Board of Managers is one-third of the total apartment owners, with a maximum of 21 members. It acts as trustee of the association and manages the common areas, facilities and funds.

Can a large township in Tamil Nadu have more than one association?

A project can have only one recognised association. Large multi-block or phased townships can form a federation of block associations by applying in Form B, with the registration certificate issued in Form C.

Does the 2022 Act help associations recover unpaid maintenance?

Yes. A registered association can levy penal interest on delayed maintenance and the dues become a charge on the apartment. These recovery powers are available only to an association registered under the Act.

Complete guide 2026

Apartment association registration in Tamil Nadu: the 2026 guide

Everything an ad hoc committee, owner or promoter needs to know to register an apartment owners association in any Tamil Nadu district under the Apartment Ownership Act, 2022.

What does apartment association registration mean in Tamil Nadu?

Every apartment building in Tamil Nadu with four or more flats is expected to have one legally recognised body that speaks for all its owners: the Association of Apartment Owners. People also call it an AOA, a resident welfare association (RWA) or a flat owners association. Its job is to own and manage the common areas, collect maintenance, appoint staff and vendors, keep accounts and deal with government departments on behalf of the owners.

Apartment association registration in Tamil Nadu is how that body becomes legal. Since the Tamil Nadu Apartment Ownership Act, 2022 came into force, there is one statewide route for every district — the same forms, the same three stages and the same Model Bye-laws whether your building is in Chennai, Coimbatore, Madurai or Hosur.

Short answer: in Tamil Nadu, an apartment association is registered by filing a Form A declaration, registering bye-laws and constituting a Board of Managers online with the jurisdictional District Registrar under the Tamil Nadu Apartment Ownership Act, 2022 and Rules, 2024.

The statewide law: TNAOA 2022 and the 2024 Rules

The Tamil Nadu Apartment Ownership Act, 2022 replaced the 1994 Act. It was notified through G.O. (Ms) No. 566 dated 23 December 2022, and the Tamil Nadu Apartment Ownership Rules, 2024 followed in September 2024. The Rules contain the forms, the fee schedule and the Model Bye-laws that every association must use as its base.

Coverage across the State

The Act covers every building with four or more apartments. It does not matter whether the building is in a corporation, a municipality or a town panchayat area. A four-flat building in Thanjavur is covered just as much as a large township on the outskirts of Coimbatore.

The authority that registers you

The State has made the District Registrars of the Registration Department the Competent Authorities under the Act. The Deputy Inspector General of Registration of the zone hears appeals. So the office that handles your association depends on the registration district in which your building stands — not on where the owners live or where the builder is based.

Only one association per project

The 2022 Act allows one recognised association per project. Every owner becomes a member automatically. Where a project has several blocks or phases, the block associations can come together in a federation.

Who files the application?

Form A can be filed by the promoter, by a majority of apartment owners, or by an ad hoc committee representing the owners. In smaller towns where the builder has moved on, the ad hoc committee route is by far the most practical.

The majority rule

More than 50% of apartment owners must support the filing. An owner with several flats counts once. For a 64-flat building with 58 distinct owners, you need at least 30 owners on board.

Committees outside Chennai

Because filing is online, a committee in Erode or Vellore does not need a Chennai address or a trip to Chennai. We run owner briefings on video call in English or Tamil, share consent formats over WhatsApp and file once the majority is in.

Document checklist

  • Approved building plan with planning permission from CMDA, DTCP or the local body
  • Building permit and, where applicable, completion certificate
  • Apartment-wise details with area and undivided share (UDS)
  • Schedule of common areas and of limited common areas
  • Owner list and majority consent
  • Draft bye-laws based on the Model Bye-laws
  • ID and address proof of the filing members
  • Board of Managers and office-bearer details (final stage)

Older buildings in tier-2 towns often have incomplete approval papers. Tell us early — we check what the District Registrar will accept before you collect consents.

How to register an apartment association in Tamil Nadu

The Registration Department's online system runs the process in three locked stages. The next stage opens only after the previous one is accepted.

Stage 1 — Declaration (Form A)

  1. Set up the ad hoc committee and choose the filing representative.
  2. Reach more than 50% owner consent.
  3. Gather plans, permits, UDS and common area schedules.
  4. File Form A online with the jurisdictional District Registrar and pay the fee.
  5. Reply to scrutiny queries until it is accepted.

Stage 2 — Bye-laws

  1. Adapt the Model Bye-laws to your building.
  2. Approve them with the owners.
  3. File them within 180 days of the declaration being accepted, with the scrutiny fee.

Stage 3 — Board of Managers

  1. Hold the general body meeting and elect the Board.
  2. Size it at one-third of the owners, with a ceiling of 21.
  3. File the President, Secretary, Treasurer and member details.
  4. Receive the registration certificate.

Government fee schedule

The declaration fee under the Tamil Nadu Apartment Ownership Rules is the same in every district:

Apartments in the buildingGovt fee (Form A)Regalwhiz package
4 to 49₹5,000Essential — fee on WhatsApp
50 to 99₹7,500Community — fee on WhatsApp
100 and above₹10,000Township — fee on WhatsApp

Bye-law scrutiny carries a separate government fee. All government fees are paid at actuals and confirmed at the time of filing, since the State can revise them.

Realistic timeline

No statutory deadline fixes the whole process, but most Tamil Nadu associations finish in three to four months. Consent collection decides the pace far more than the office does.

PhaseWork involvedWhat drives the time
GroundworkCommittee, consents, documentsOwner response and builder cooperation
DeclarationForm A filing and scrutinyDistrict Registrar's queue
Bye-lawsDrafting, approval, filing180-day outer limit after acceptance
BoardGBM, elections, filingMeeting notice periods

Board of Managers rules

The Board is one-third of the owners, capped at 21. A 24-flat building in Madurai would have 8; a 900-flat project near Coimbatore still has 21. The Board is the association's trustee: it runs the common areas, the funds and the facilities, and its office-bearers must be kept up to date with the Registration Department.

Model Bye-laws and local customisation

The 2024 Rules include Model Bye-laws that each association adopts with changes for its own building. Common customisations we make for Tamil Nadu clients include:

  • Maintenance split by area, by flat or a mix — with late-payment interest
  • Covered, open and visitor parking allocation
  • Water supply rules for buildings relying on tanker or borewell water
  • Pets, tenants and short-stay rentals
  • Sinking fund and major repair contributions
  • Election process, terms of office and quorum
  • Use of clubhouse, pool and community hall

Federations for large townships

Phased and multi-block projects — common around Chennai, Coimbatore and Hosur — can register a federation of block associations. The application is in Form B; the certificate is issued in Form C. The federation manages township-wide amenities, while each block association runs its own building.

What registration gives your association

  • Legal standing to sign contracts, hold property and go to court
  • Recovery of dues with penal interest and a charge on the defaulting flat
  • Own PAN and bank account so funds are never in a member's name
  • Authority before departments such as the local body, electricity and water utilities, and the police
  • Proper builder handover of common areas, documents and corpus fund
  • Redevelopment readiness for older buildings

What happens if you do not register?

Contravening the Act, the Rules or the bye-laws can lead to a fine of up to ₹1,00,000 on conviction and up to ₹500 for each day the contravention continues. More practically, an unregistered committee cannot use the statutory recovery tools, and banks, utilities and courts may not deal with it.

Compliance after registration

  • Get a PAN and open the association's bank account.
  • Keep books and get them audited as the bye-laws require.
  • Hold general body meetings and record minutes.
  • Report Board changes to the Registration Department.
  • Check GST every year: member contributions up to ₹7,500 per member per month are exempt, and registration matters only above the turnover threshold. See GST registration.
  • Deduct TDS on contractor and security payments where it applies.
  • With 10 or more employees, meet POSH Act duties — see POSH training.

Mistakes we see across Tamil Nadu

  • Registering a new society under the Societies Registration Act instead of using the 2022 Act.
  • Filing in the wrong registration district — jurisdiction follows the building, not the owners.
  • Counting flats, not owners, for the majority.
  • Using bye-laws from another city that do not match your UDS or amenities.
  • Letting the 180-day bye-law window lapse.
  • Waiting years for the builder when owners can file themselves.

District notes for Tamil Nadu

Chennai and its suburbs

The highest volume of filings. Suburban projects may fall under Chengalpattu, Kancheepuram or Tiruvallur registration districts. See our dedicated apartment association registration in Chennai page.

Coimbatore, Tiruppur and Erode

Fast-growing apartment markets with many gated communities on the city fringes, where builder handover and common-area disputes are common reasons to register.

Madurai, Trichy and Tirunelveli

A mix of older mid-size buildings and newer projects. Older buildings often need help aligning past welfare associations with the 2022 Act.

Salem, Hosur and Vellore

Hosur's industrial growth has brought large townships where federation planning matters early on.

Wherever you are, we confirm the jurisdictional District Registrar before filing. Related services: NGO and trust registration, company formation and trademark registration.

More questions answered

Are the rules different in Coimbatore or Madurai compared to Chennai?

No. The Act, Rules, forms and fees are the same across Tamil Nadu. Only the District Registrar office changes, based on where the building is located.

Do older buildings from the 1990s need to register under the 2022 Act?

Yes, if they have four or more apartments. Older buildings often have an informal welfare association; it should be brought under the 2022 Act so that it can use the statutory powers.

Can the Form A filing be done in Tamil?

The online forms follow the Registration Department format. Regalwhiz explains every step to owners in Tamil or English and prepares the filing for you.

What if our builder in another city does not respond?

Owners can file through an ad hoc committee without waiting for the builder. Regalwhiz sends a formal document request and works with whatever approved documents the owners already hold.

Does a registered association need its own PAN and bank account?

Yes. After registration the association should obtain a PAN, open a bank account in its own name and keep audited accounts as its bye-laws require.
